Terms of Service

Mystik Media dba Algadon, hereafter referred to as “the company”, operates Algadon with the following Terms of Service.  By playing Algadon, you agree to be bound by these terms.

Disclaimer

1. The company is not responsible for any illegal, offending, or inappropriate actions made by users inside or outside of the game, including Internet and “real-world” actions.
2. The company reserves the right to deny any person access to the game for any reason.
3. The company has no obligations toward any player.
4. The company may elect to ban or delete an account when the rules are broken.
5. The company has the right to make decisions based on non-written rules or to adjust the rules in the future without prior notice.
6. Players of Algadon that purchase gems have no extra entitlements, privileges, or considerations. “Entitlements” are licensed rights granted, awarded, provided and/or purchased by you to access offline or online features of Mystik Media dba Algadon products or services.
   
   The purchase of gems, including but not limited to virtual gold or points (virtual items), are for use in the game Algadon. You do not in fact “own” the Virtual Items and any amounts of any virtual Item nor does it refer to any credit balance of real currency or its equivalent.
   
   The company grants you a personal, limited, non-exclusive license to use Content and Entitlements to which you have access for your personal, private, non-commercial, non-transferable, and limited use set forth in the Terms of Service.
7. Algadon may not be appropriate for persons under the age of 18 due to language and/or avatar use by other players.  By joining the game, you agree that you are 18 or older or have parental permission to play.
8. By creating an account and sending in-game messages, you agree to allow the company to access the mail if needed without advance permission.
9. The company is not responsible for any injuries sustained while playing the game including but not limited to carpal tunnel syndrome.
10. The company does not guarantee that you will be able to access to the game at all times or gain access to all parts of the game. Certain parts of the game may be unavailable due to browser, firewall or security settings, or other issues.
11. The company reserves the right to change or modify the TOS at any time without warning or notification. It is the responsibility of the user to be aware of and in compliance with the Terms of Service at all times.

Rules

1. No form of refresher, auto-clicker, automated program or macro is permitted.  While we may not always monitor for such usage, if it is detected, the account may be subject to immediate termination.
2. Do not spam other players.  Spam consists of sending unwanted mass messages, “mail bombs”, etc.
3. Do not change your name with the purpose of harassing or malicious intent against another player. While many avatars are not personally owned, they should not be used with the sole purpose of duplicating another player. Someone having the same avatar by chance would not be subject to this rule. Other evidence is required, such as the name also being mimicked or past evidence.
4. Do not ask other players for personal information inside the game.  If you become friends with another player, please exchange any information outside of the game.
5. Exploitation of any bugs or holes in game mechanics will not be tolerated. We will use discretion as to what is considered cheating on a case-by-case basis, and we will take immediate action against any account we determine
   to be violating the rules.  Please immediately report any exploits or bugs found in the game.
6. The use of racism or hate material in your player name, avatar, clan name, or any other location within the game is prohibited.
7. If you feel the need to call another player an inappropriately offensive name, please do so in a Facebook private message.  Do not include the references in the official forums, groups, or player profiles.  Continued failure to follow this rule may result in being banned from the game.
   If you are offended by any player’s post, simply use the Ignore feature to block their posts from being displayed.
8. You may not sell, trade, or return accounts or any in-game forms of virtual property/currency for real world money.
   All virtual currency purchases are final.
9. If a chargeback/dispute is made on a virtual currency or bonus payment, the account associated with the payment is subject to ban. If you do not receive gems or promotion item, contact support for assistance.
10. Nearly all software and games beyond the most simple are prone to bugs, and input errors can occur from time to time (developers are human, after all). Algadon must strive to fix such issues, and handle them in a manner that is fair for everyone as much as possible.
11. If your account remains inactive for longer than 6 months, the account may be deleted.
12. Extortion for game money is prohibited. (Example, “give me 50,000 gold, or I will keep attacking you non-stop until you do”)
13. Under no circumstance does purchasing gems make you exempt from the rules. We appreciate all support for the game and purchases, but we are determined to maintain a fair environment to play and will take action as necessary.
